WATCH: 'Separate and unequal' - Interview on Israel's legal system

I recently sat down for an interview with activist and filmmaker David Sheen, as part of a larger project he is working on. We discussed Israel’s legal system and the distortions inherent in it, and the possible avenues for change in Palestine and Israel.

I provide a breakdown of the structure of citizenship in Israel and the different sectors of the population under Israeli control and how the law applies to them.  It’s a system in which there is no single rule of law and in which discrimination and injustice are part and parcel of the legal structure.

      The premise that all people should have equal rights in all countries is unrealistic.
      The very reason why Israel exists is that Jews don’t have equal rights in non-Jewish countries.

      Likewise non-Japanese don’t have equal rights to Japaneses in Japan.
      I agree that it would be nice if it was different, but Jews cannot afford to abandon their only safe-heaven, while everyone else is nationalistic.

    2. VIIIT, above is very honest. The case of Japan doesn’t quite fit, for there are not large numbers of indigenous people there who are not Japanese. Israel has been unable to win its independence war completely, not been able to push the Palestinians out in toto much as the US did to indigenous Native Americans. What VIIIT wants cannot be without massive cruelty. But that does not mean that Israel is lost. The Declaration of Independence provides a way out (he says yet again), insuring free ingress for Jews but also insuring full eqaulity in social and political rights for all. It will be painful to get there, yes, but the alternative is to wait for violence to begin again. There are too many people for Israel to expunge; eventually, that will have to be accepted. The longer the delay, the more hatred and anger there will be to contend with.

      I know there is no easy love fest answer to the problem. But the longer you delay in the prospect of failed total nationalism, the worse the transition will be, at some points. And there is another consideration: imposing these shackles on others, are the values of the Jewish Dispora being lost? Can a Jewish State become, in some ways, non-Jewish through the very act of forcing the surrounding world to be what it wants?

      That is because there was no such goal – to completely remove all and any Arabs.

      The sun of truth has blinded you. If you don’t honor your Declaration of Independence you will be imposing more cruelty on your fellow non Jewish citizens; if you continue to build new settlements and expand those present you will be limiting the lives of those resident there for generations. One more time: the Declaration insures free ingress of Jews into Israel; it also insures full rights of equality in social and political rights irrespective of race, sex, religion, or creed. I’m certain you’ve looked it up and found the words are there. Bother.

      If you reify race the Declaration still works; it just says that the real category of race cannot be used to infringe rights.

      I am aware of the Ainu in Japan; proportionately, they are not as your Arab citizens. They change nothing, unless you want to advocate racial suppression as a real good–for your race.

      Now that’s a nice good chunk of nonsense.
      Barely any cruelty is imposed on Israeli Arabs. Certainly much less that in any Arab country.

      We can’t CONTINUE building NEW settlements – it’s logically impossible – we could only START building NEW settlements, as of expanding those present – some of them will became an integral part of Israel very soon.

      And again you are singling out Israel. You probably are aware how long it actually took UK, USA, France, Germany or almost any modern democracy to became such. But Israel has no right for mistakes, therefore it has no right to exist.

      Expunging is generally the result of hostile activity conducted in the past by those being expunged. Again – until entire Ummah accepts Israel’s right to exists nothing is gonna be easy to anyone.

      Interview is mostly correct btw, however there is more to the issue, which was not covered by Roi. Israeli society is quite segregated, reasons to that are simple and understood by each and every Israeli.

      Oh, almost nothing.
      You see, we are too busy fighting off enemies and such. Stupid it is to expect changes in society which is constantly threatened by it’s neighbors.
