		<description>K9, no.  Hearings are granted, people are not thrown across the boarder but arrested.  Hearings may be pretty useless to the arrested, but they ocurr.  Nor are Mexican nationals crossing the boarder associated with a presumed refugee class under treaty; that the High Court priorly forbade removal of Eritreans under treaty makes Eritreans on Israeli soil presumptively crys for asylum.  We are talking about a hearing here, not ultimate admitance.   

When the rule of law is only to satisfy your racially protective needs it will ultimately fail and, I assure you, turn on Israeli nationals as well.  The fight for the rule of law is a fight for your future.  The law can advance for you, sometimes, by letting your enemies win.</description>

I cannot believe an American Federal Court would have postponed hearing for two days, leaving refugees in the desert.  The court would have ordered them remanded into custody pending hearing.  That the High Court did nothing suggests to me that Justices were told the problem would soon go away...and THAT is a sign the Court is not fully independent.  There can be no rule of law in such a case.</description>
