Unless you can explain to me how practically a fence can be built on exactly the border without infringing on Egyptian sovereignty you will have to accept that by international convention the fence constitutes a legal border. By the time these migrants get to Israel they have already gone through two states in neither of which they were in immediate danger and in one of which they could claim legitimate refugee status.
